Work Permit

Common requirements for a General Work Permit, Quota Work Permits, Intra Company Transfer Work Permit, Exceptional Skills Permit:

At the discretion of the Director - General, proof of a valid air ticket.

A deposit or a written undertaking by the employer accepting responsibility for the cost related to the deportation of the applicant and his or her dependent family members respectively.

Yellow fever vaccination certificate if he or she traveled or intends traveling from or through a yellow fever endemic area.

Police clearance certificate.

Medical and radiological reports in respect of each applicant. Radiological report shall not be required in respect of children under the age of 12 years or pregnant woman.

The documentation relating to minor dependent children accompanying the applicant or joining the applicant in South Africa.

Documentation relating to his marital status or spousal relationship. i.e marriage certificate.

An application for a GENERAL WORK PERMIT shall be accompanied by:

A contract of employment stipulating the condition of employment and signed bu both the employer and the applicant.

Proof of qualification evaluated by the South African Qualification Authority and translated by a sworn translator in English.

Proof of experience and skills in line with the job offer.

Letter from the employer motivating why a citizen or permanent resident should not fill up the position, as well as proof of efforts made to obtain the services of a citizen or resident, together with particulars of the unsuccessful candidates.

Proof of advertisements, steps taken to fill the post, how many South African citizens / permanent residents applied and why they were found unsuitable.

An undertaking by the employer to inform the Director General, should the applicant not comply with the Act or leave the employer.

If required by law, proof of registration with the relevant professional body,council or board.

Full particulars of the employer, including, if applicable, proof of registration of the business with the Registrar of Companies.

A certificate from the Department of Labour or an exact from the database of a salary benchmarking organization stipulating the average salary earned by employees occupying similar position in the Republic.

*NB The general work permit shall lapse if within six months of its issuance, and within every year thereafter, its holder fails to submit satisfactory proof to the Director General that hr is still employed and of terms and conditions of his employment, including the job description.

An application for an INTRA COMPANY TRANSFER WORK PERMIT shall be accompanied by :

The foreigner's contract of employment with the company abroad.

A letter from :
a) The company abroad confirming that the foreigner shall be transferred to a branch of that company or an affiliated company situated in South Africa.
b) The South African company confirming the transfer of the foreigner as well as specifying the occupation and capacity in which that foreigner shall be employed

The relevant employer shall ensure that:
a) The passport of the foreigner is valid at all times.
b) The foreigner is only employed in the specific position for which the permit has been issued.
c) The foreigner departs from the Republic on completion of his tour of duty.
